The Metropolitan Transportation Authority (“MTA”), in accordance with regulations promulgated by the United States Department of Transportation (“USDOT”) at 49 C.F.R. Part 26, announces that it is proposing to establish a goal of awarding 17% of the value of federally funded contracts to Disadvantaged Business Enterprises (“DBE”) during federal fiscal year 2008.

This goal will apply to the total sum of all federally funded contracts awarded by the following constituent agencies of MTA:

MTA
MTA Long Island Rail Road
MTA Metro-North Railroad
MTA Long Island Bus
MTA Bus Company
MTA New York City Transit
MTA Capital Construction Company

The purpose of the goal is to promote participation by DBEs on federally funded contracts awarded by MTA and its constituent agencies. Under federal regulations, a DBE consists of any small business run for profit which is majority-owned and controlled on a daily basis by individuals who are socially and economically disadvantaged. Women and minorities are presumed to be socially and economically disadvantaged, although this presumption may be rebutted.

This notice is published in accordance with 49 C.F.R. Section 26.45. The goal and its rationale are available for inspection during normal business hours at the following address for 30 days following the publication of this notice: MTA Office of Civil Rights, 2 Broadway, 16th floor, New York, New York 10004. Comments regarding the notice and its rationale will be accepted for 45 days following the publication of this notice at the same address and at the USDOT, Office of Civil Rights, 400 7th St., SW, Room 9114, Washington, D.C. 20590.

Comments received may be used by MTA in establishing its goal for DBE participation on federally funded or assisted contracts awarded by MTA and its constituent agencies.
